CONTEST TERMS AND CONDITIONS - JavaScript Summer Challenge

Article 1. Organization.

The organizer of the contest is Pentalog ROMANIA SRL (hereinafter referred to as “Pentalog”), with registered office at Brasov, Garii Boulevard no.13A, 2nd floor, Brasov, Romania, with Trade Register Number J08/769/1999, CIF RO12123007, dully represented by Monica Jiman, acting as Administrator, hereinafter referred to as the “Organizer”.

The participants are required to comply with the terms and conditions of the JavaScript Summer Challenge, terms and conditions of the Organizer, statutory requirements, and regulations, according to the provisions listed below (hereinafter referred to as the “Rules and Regulations”). Rules and Regulation will be communicated to the participants and any other interested persons, on the Organizer webpage, as follows: https://www.pentalog.com/it-outsourcing/javascript-summer-challenge/

 

Article 2. Participants. Exclusions

This free competition with no obligation to purchase is exclusively open to individual persons, IT professionals, who are over 18 years old on the start date of the game, residing in Romania, Republic of Moldova, Morocco, Vietnam, Mexico (proof of residence might be requested before handing over the prize).

The language of the contest is English, and the communication channel is made through Pentalog Connect webpage.

Targeted specializations:  Frontend developers and web developers, not limited.

Excluded from the contest are the following:

  • Members of the staff/employees, collaborators, subcontractors of the Organizer,

  • any person who directly or indirectly participated in the design, production or management of the quiz.

Please note, the following participants will be disqualified:

  • People who have not used the same first and last name and e-mail address to enter the contest. An identity card is required for identification and to receive the prizes.

  • Employees of Pentalog Group companies.

  • Entrants who have been caught cheating the system (illegitimate use of e-mail addresses, passwords or other personal information to win);

  • Those who participated in the JavaScript Summer Challenge  under different identities.

  • Any participant who has already participated in any other competition organized by the Organizer and who has been designated the winner during the last six months.

  • Any Participant who has been disqualified by the Organizer.

  • If the Organizer considers that a participant has cheated in any way, the Organizer reserves the right to disqualify this participant without having to provide detailed explanations.

  • The participant must complete the information form completely and correctly for his registration to be validated. The player is informed and accepts that the information entered in the registration form constitutes proof of his identity.

  • Any participation made contrary to the provisions of these rules will render the participation invalid. Any participant suspected of fraud may be excluded from the competition by the Organizer without the latter having to justify it. Any incomplete, erroneous or illegible identification or participation, whether intentionally or not, or carried out in a form other than that provided for in these rules will be considered void. The same sanction will apply in the event of multiple participation.

 

The Organizer reserves the right to ask any participant to justify the conditions set out above. Anyone who does not meet these conditions or refuses to justify them will be excluded from the JavaScript Summer Challenge and will not be able, in the event of a win, to benefit from their prize.

Only one entry per person is allowed (same name, same surname same email address).

The Organizer reserves the right to carry out any checks for compliance with this rule.

Participation in the contest implies full acceptance of the Rules and Regulation.

 

Article 3. Participation. Description of the Contest

Participants must go to the competition section on Pentalog web page: https://www.pentalog.com/it-outsourcing/javascript-summer-challenge/ 

The Organizer hosts the contest (hereinafter referred to as the “JavaScript Summer Challenge”) where the contestants need to login and solve the following quizzes: 

1. Frontend Most Wanted Stack Quiz / medium level
Sharpen your skills with 20 questions in 20 minutes.

2. Web Development Practices quiz / advanced level
Push your knowledge to the limits with 25 questions in 50 minutes.

3. JS Self-assessment
A multi-step voyage with no time limit, culminating in your results being analyzed by our state-of-the-art VETA (Validating Every Talent Assessment) system, powered by OpenAI’s DaVinci model.

The JavaScript Summer Challenge is composed from 2 quizzes & 1 self-assessment test (mandatory to be completed). 

 

Article 4. Period and duration of the contest

The JavaScript Summer Challenge will start on August 7th, 2023. The duration of the contest is 25 days and will end on August 31st, 2023, midnight, UTC + 2:00. The contest will be active only in this period. Any quizzes completed after won’t be considered.

 

Article 5. Allocated JavaScript Summer Challenge prize
The prizes involved are:

1. Exclusive custom-made 8-hour training with Victor Rentea, Technical Trainer, and Clean Code Coach with over 17 years of coding experience, for the first 20 participants.

2. 5 multi-pass tickets for the most popular JS conferences, organized by GitNation: https://portal.gitnation.org/multipass for the first 5 participants.

3. Free remote access to 50% of talks at the chosen conference https://reactday.berlin/, offered to all the participants. 

4. Ticket Raffle: one remote and one hybrid ticket for raffling at https://reactday.berlin/, dedicated to all the participants. 

The value of the prize is determined at the time of drafting of these Rules and Regulation and cannot be the subject of a dispute as to its evaluation.

We reserve our right to add additional prizes to encourage users from different geographies to enroll the program. 

All costs incurred after the JavaScript Summer Challenge, in particular for the use and maintenance of the prize, are entirely the responsibility of the winner.

 

Article 6. Determination of the winners

The winners will be considered the first 20 participants which obtained the highest score.

In order to be validated, the contestant must complete all the steps: the 2 quizzes and the self-assessment.

After the end of competition, on August 31st, 2023 the Organizer will take 5 business days in order to evaluate and establish the list of 20 winners, according to their score. Also, offer the 2 raffle tickets. 

The winners will be informed in the 6th business day after the end of the contest.

The winners will have 5 days to respond to the Organizer’s email and confirm the acceptance of the prize.

The lack of answer to the email and/or the reply with “NO” (the winner doesn’t want to receive the prize) will be considered as refusal and disqualification of the winner.

 

Article 7. Publicity of the winners

The list including the winners will be available on the JavaScript Summer Challenge website: https://www.pentalog.com/it-outsourcing/javascript-summer-challenge/ 

The winner will also be contacted by the Organizer in writing, through the email used for creating the account on the contest webpage.

 

Article 8. Delivery of the prize

The prize will be assigned only to the winners that accepted and responded to the Organizer’s email for confirmation.

After confirmation of the prize, the winner will be contacted on the same email address directly by its partner, GitNation (https://portal.gitnation.org/), in order to set up the multi-pass account. The Organizer will handle the logistics of the 4h online training with Victor Rentea. 

 

The winner agrees to accept the prize as proposed without the possibility of exchange, in particular for cash, other goods or services of any kind whatsoever or transfer of the profit to a third person. Likewise, this prize may not be the subject of compensation claims.

 

The Organizer reserves the right, in the event of an event beyond its control, in particular linked to its suppliers or to unforeseeable circumstances, to replace the advertised prize with one or more prizes of equivalent value. The winner will be kept informed of any changes.

 

Article 9. Use of personal data of the participants

The participants’ information (surname, first name, e-mail address and telephone number) are recorded and used by the Organizer to allow their participation in the competition, handover the prize and/or communicate with the winner for any other reasons related to the contest or future collaboration, by case.

Article 10. Terms & Conditions. Rules and Regulation

The  JavaScript Summer Challenge  will be organized according to the present Rules & Regulation, which is mandatory for all participants and for all entities involved in the running of the JavaScript Summer Challenge and in accordance with the Romanian applicable laws, especially the provisions of Law 506/2004 on the processing of personal data and the protection of private life in the electronic communications sector and the provisions of the European Regulation 679/2016 on the protection of natural persons, regarding the processing of personal data and on free movement of these data.

The general Terms of Use of Pentalog Group web resources can be consulted on the following link: https://www.pentalog.com/terms-conditions/ , subject to full acceptance by the participants. Any other details regarding the Organizer’s activity can be found here.

 

The Organizer reserves the right to modify and/or supplement the Rules and Regulation at any time, as well as the right to suspend and/or terminate/interrupt/extend the JavaScript Summer Challenge at any time, provided that the participants are notified in advance of any modification of any of its provisions. Any changes/completions will be communicated to the public by publishing them on the website, before they enter into force. Also, any questions or concerns can be addressed to the Organizer at the following address: Brasov, 13A Garii Boulevard, 2nd floor, Brasov, Romania.

 

According to the Organizer’s free decision, the JavaScript Summer Challenge can be promoted for the purpose of informing the public, including through advertising and/or informative materials. The information on that such materials may contain will be interpreted in accordance with the provisions of this Rules and Regulation.

 

By participating in this contest, full, express, and unequivocal knowledge and compliance with all the terms, conditions and provisions of the JavaScript Summer Challenge and Pentalog regulations, the participant’s agreement are assumed. The participants undertake to respect and comply with all of terms, conditions and provisions of this Regulation.

 

Participants expressly understand and accept the fact that the Organizer reserves the right to interrupt / stop the running of this JavaScript Summer Challenge  at any time and to modify its validity period mentioned above at any time, if, at any time during the JavaScript Summer Challenge, the Organizer’s activity will be closed or restricted in any way, due to legislative changes and/or measures established by public authorities at local and/or national level, depending on the evolution of legal restrictions in the context of health situations (e.g. epidemics, wars, pandemics and/or other health situations, such as the competent authorities will decide) on the basis of the extension of the state of alert or the establishment, as the case may be, of the state of emergency on the territory of Romania, which would lead to the modification of this Rules & Regulation.

The Organizer’s decisions regarding the present JavaScript Summer Challenge  are final and applicable to all participants.

 

Article 11. Intellectual property rights

The reproduction, representation or use of all or part of the elements making up the JavaScript Summer Challenge, image and logo of the Organizer, these Rules and Regulations and Pentalog related intellectual property rigts included are strictly prohibited.

 

You agree that all materials, products, and services provided on the website are Pentalog’s property including its affiliates, directors, officers, employees, agents, suppliers, or licensors including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce or redistribute Pentalog’s intellectual property including but not limited to its brand, name, trademark, in any way, including electronic, digital, or new trademark registrations.

 

All brands, logos, texts, images, videos and other distinctive signs reproduced on the site as well as on the sites to which it allows access through hypertext links, are the exclusive property of their owners and are protected as such by the provisions of the Intellectual Property Code for the whole world. Their unauthorized reproduction constitutes an infringement liable to criminal penalties.

 

Participation in this game implies full and complete acceptance of these rules by the participants.

 

Article 12. Liability

The responsibility of the Organizer cannot be engaged in case of force majeure or fortuitous events beyond its control.

The Organizer cannot be held responsible for delays, losses, theft, damage to mail, lack of legibility of stamps and signatures due to the third parties’ services. It cannot be held responsible either and no recourse can be brought against it in the event of the occurrence of events presenting the characteristics of force majeure (strikes, riots, wars, tornado, floods etc.) partially or totally depriving the participants of the possibility of participating in the competition and / or the winners of the benefit of their winnings.

The Organizer as well as its service providers and partners can in no way be held responsible for any incidents that may occur in the use of the endowments by the beneficiaries or their guests once the winners have taken possession of them.

 

Likewise, the Organizer as well as its service providers and partners, cannot be held responsible for the loss or theft of the endowments by the beneficiaries once the winners have taken possession of them. Any additional cost necessary for taking possession of the prizes is the sole responsibility of the winners, without the latter being able to request any compensation from the Organizer nor from the service providers or partners.

 

Article 13. Claims

The Organizer reserves the right to settle without appeal any difficulty that may arise as to the interpretation or application of these Rules and Regulations, it being understood that no dispute will be allowed, in particular on the terms of the contest, on the results on the winnings or their receipt, one month after the end of the competition. Except in the case of obvious errors, it is agreed that the information resulting from the game systems of the Organizer have probative force in any dispute as to the elements connection and computer processing of said information relating to the contest.

Any complaint must be addressed within one month of the end of the game to the Organizer. After this date, no complaint will be accepted. Participation in the game entails full acceptance of these rules.

 

Article 14. Convention of proof

By express agreement between the participant and the Organizer, the computer systems and files of the Organizer will serve as the only proof.

The computerized registers, kept in the computer systems of the Organizer under reasonable conditions of safety and reliability, are considered as proof of the relations and communications between the Organizer and the participant.

It is therefore agreed that, unless there is a manifest error, the Organizer may rely, in particular for the purposes of proof of any act, fact or omission, of the programs, data, files, recordings, operations and other elements (such as monitoring reports or other reports) of a nature or in computer or electronic format or medium, drawn up, received or stored directly or indirectly by the Organizer in particular in its computer systems.

The elements considered thus constitute proof and if they are produced as means of proof by the Organizer in any contentious or other procedure, they will be admissible, valid and opposable between the parties in the same way, under the same conditions and with the same probative force as any document drawn up, received or kept in writing.

Transactions of any kind carried out using the identifier and code assigned to a participant, following registration, are irrefutably presumed to have been carried out under the responsibility of the participant.
